Profile
Mark Sherrill is a seasoned bankruptcy and restructuring attorney with deep experience at the intersection of financial markets, energy, and commodities. As a shareholder in the firm’s Bankruptcy practice group, Mark guides clients through complex insolvency matters, offering practical counsel informed by years of work on some of the nation’s most significant bankruptcy cases.
Drawing on his background with derivatives and structured transactions, Mark regularly advises energy companies, commodity traders, and investment funds on strategies to manage credit and liquidity risk. He has helped clients navigate distressed counterparty situations, structure asset-based financings, and negotiate trading and purchase agreements across the energy and commodity sectors. His work often involves helping protect client interests when insolvency issues intersect with the trading of physical and financial energy products.
Beyond the energy and commodities space, Mark has represented a wide range of parties in major bankruptcy proceedings, including debtors, lenders, secured creditors, noteholders, and post-confirmation trustees. His experience extends to major bankruptcy cases in the crypto, manufacturing, aviation, and retail sectors. His practice also encompasses distressed asset acquisitions, alternative dispute resolution, and bankruptcy-related litigation at both the trial and appellate levels.
Earlier in his career, Mark served as a law clerk to the Honorable Randolph Baxter of the U.S. Bankruptcy Court for the Northern District of Ohio.
Representative Experience
- Represented secured lenders in real estate bankruptcy cases.
- Assists investors and other companies (in their roles as equity, working interest holders, noteholders or other forms of creditors)
- Represents purchasers of assets out of bankruptcy, such as the participant in a joint venture purchasing oil storage assets in the Virgin Islands and the buyer of an 837 MW gas-fired generation facility in Mississippi.
- Serves as counsel to DIP lenders in such cases as a New York-based energy finance company and a Louisiana-based offshore E&P company.
- Represented private equity fund as deal counsel in its successful bid and acquisition of four coal-fired power plants totaling 1200 MW of generation capacity in New Jersey, West Virginia and Arkansas, including back leverage financing to support the acquisition.
