Daniel M. Horowitz

Daniel Horowitz maintains a wide-ranging complex commercial litigation practice with particular emphasis on large-scale business disputes, antitrust, and constitutional actions. His numerous matters include representing a Fortune 500 company in antitrust actions brought by some of the nation’s largest retailers and representing an insurer in coverage disputes against distributors of opioids.

Beyond his high-stakes commercial litigation practice, Daniel also represents clients in significant constitutional challenges. He has defended the Public Campaign Financing and Election Commission of the State of New York against a challenge to its authority to issue recommendations to establish a public campaign financing program in New York State, and the Governor of the State of New York in a challenge to a statute related to salaries for legislators and executive-branch employees. 

Daniel is also a leader in the firm’s pro bono efforts, and his contributions have helped to secure HSG’s recognition from Law360 as the number one boutique in the nation for pro bono work, and Benchmark Litigation’s Pro Bono Firm of the Year. His recent representations include incarcerated individuals seeking to vindicate their constitutional rights, and clients in divorce actions through Her Justice. He also represented a Cuban asylum seeker who the United States deported to Cuba, yet Daniel successfully prevailed at the U.S. Court of Appeals for the Fifth Circuit and the Board of Immigration Appeals to have the deportation order vacated.  Daniel thereafter helped facilitate his client’s return to the United States. 

Before joining Holwell Shuster & Goldberg, he served as a judicial law clerk to the Hon. Priscilla R. Owen of the U.S. Court of Appeals for the Fifth Circuit, and the Hon. Frederic Block of the U.S. District Court for the Eastern District of New York. A film and television production major at New York University, before law school, Daniel worked in the independent film industry in New York.

He was named to the 2024 Benchmark Litigation’s 40 & Under List (2024) and the Lawdragon 500 X – The Next Generation list.

• Leading role in the firm’s representation of Chubb on claims brought by major manufacturers, the nation’s largest drug distributors, and its largest pharmacy chains seeking insurance coverage for lawsuits seeking to abate the national opioid epidemic.
• Chubb in coverage litigation concerning Mattel and its subsidiary Fisher Price’s Rock ‘n Play sleeper.
• Visa Inc. and its subsidiaries in various matters, including their defense against class and individual antitrust actions brought by virtually every merchant in the United States and alleging hundreds of billions of dollars in damages.
