In a recent Houston Business Journal article, Kisshia Simmons, attorney in the Chamberlain immigration practice in Houston, discusses the registration process for H-1B visas, which provide temporary work authorization for foreign workers employed by U.S. companies in certain specialty occupations.
Simmons shared that employers previously concerned about filing for entry-level or lower-paid positions received a temporary reprieve when the Biden Administration announced it would delay changes to the H-1B visa program introduced by the Trump Administration in a Federal Register Rule to give USCIS more time to develop, test, and implement the modifications to the H-1B registration system and selection process.
"If implemented, the changes would eliminate the lottery and instead give preference to the highest-paid or highest-skilled workers, favoring high-paid industries over small businesses, nonprofits, or universities that typically offer lower wages regardless of qualifications," said Simmons.
