In an article published on July 15, 2020 in Law360, Philadelphia-based Shareholder Jennifer Karpchuk discusses whether Wayfair will continue to play a key role in filling budget gaps as states grapple with revenue shortfalls resulting from the COVID-19 health crisis.

“With an economy that has become even more reliant on e-commerce over the past few months, a physical presence standard would have greatly limited states' sales tax collections during the COVID-19 shutdowns and closures of many brick-and-mortar businesses,” explains Karpchuk.

Karpchuk further explains that another consequence of the fiscal impact of COVID-19 on state and local taxes may be that states will seek to impose collection obligations on more taxpayers.
