“Recording Online Meetings: A Guide to eDiscovery Best Practices" article by Gina Vitiello in Daily Report
In an article for the Daily Report published Friday, November 8, 2019, Shareholder Gina Vitiello discusses the potential risks associated with recording online meetings and provides best practices to consider.
Vitiello explains that online meetings have become more commonplace and save time for most companies, but present a challenge when litigation is involved. Most major meeting software products have the ability to record the meeting, any screen shares and all “chat” window information.
“Recorded files are saved either to the local machine of the person who hosted the call or on the server where the software resides,” Vitiello explains. “The host of the session makes this choice. These records can cause issues on both ends of the call cycle. Firstly, when a meeting invitation is issued, users may not be aware that the meeting is being or could be recorded; therefore, a disclaimer may be necessary when an invitation to such a call goes out. Secondly, where the resulting recorded file is saved could affect which custodians and servers need to be included in an eDiscovery request.”
Vitiello recommends all online meeting invitations be accompanied with a disclosure statement explaining the service allows for sessions to be recorded, which may be discoverable in a legal matter.
