On August 14, 2025, Bloomberg Tax and Bloomberg Law published an article from Shareholders Chuck Rettig, Tom Cullinan, and John W. Hackney that discussed how President Trump’s tax-and-spending package and an executive order may change the tax enforcement landscape for green energy tax incentives.
“The IRS needs to remain neutral in its administration of the tax laws. From a tax perspective, there is nothing nefarious about green energy transactions that should cause the agency to allocate excessive resources to audit more than traditional sampling and risk profiling would suggest,” Cullinan, Hackney, and Rettig said.
In the article, the attorneys explain what green energy audits may look like and emphasized that the aim in green energy audits is to resolve them quickly and without changes since certainty is valuable in tax matters.
“While the reduction in IRS staff could make audits last longer, in our view, that decline actually may support speedier resolutions.”
