Tax case of the millennium’ hits high court

In an article published in Accounting Today on April 13, 2018, Chamberlain attorney Jennifer Karpchuk provides commentary on South Dakota v. Wayfair, the biggest U.S. Supreme Court tax case in years.

The case challenges a 1992 Supreme Court decision prohibiting states from imposing sales tax collection obligations on vendors lacking an in-state physical presence. “You can't have a free-for-all, or a situation where all retailers can instantly be taxed in any jurisdiction, but establishing a threshold, or any similar decision, will be tough for the court, as they want to remain a judicial body, not a legislative one," she said.
