Back in the early days of yesteryear, software companies ran the global technological stratosphere armed only with the usernames of their participants. Rerouting an IP number was the height of hacking prevention, a cookie was just something you enjoyed with your favorite ice cream, clouds were only important to three year olds and meteorologists… and clocks would constantly strike thirteen on those bright, cold April days. As we try to navigate the ever-changing world of the information age, it has now become more important than ever to step into the light of (computer) knowledge. Join us in the place where the darkness hasn’t touched, as we discuss data, its restriction and obligations, and how to strategically think about its implications for the future.

Presenters: Chad Muller and Leo Unzeitig

Discussion regarding current IRS examination practices and priorities. We will cover the tax issues currently being raised in exam, how to defend them, and how to preserve a case for trial. Also included will be a discussion regarding the IRS’ increasing use of penalties.

10:00 – 10:50 AM - Top employee beneļ¬t plan compliance issues for plan sponsors to understand for 2022-2023

Presenters: Joshua Sutin and Jeffrey Della Rocco

This seminar will review the most common compliance errors we are seeing and how to avoid or correct if you encounter an employee benefit plan compliance matter. We will cover current DOL, IRS and HHS guidance relating to qualified retirement plans, nonqualified deferred compensation plans and welfare plans. The seminar will provide a checklist of items for CPAs and plan sponsors to make sure that an employer is following the law and understanding the current changes impacting employee benefit plans.

Presenters: Sebastien Chain and Ryan Reneau 

Discussion regarding recent issues raised by cross-border family business planning. We will cover passive foreign investment company distributions, inversion rules and consequences, fideicomiso classifications, and US real property transactions under FIRPTA.

Keynote Lunch Discussion: Texas State Taxes – Procedures, Audit and Litigation Update

Presenters: Justice David Medina, Adrian Ochoa and Daizia Williams

Discussion regarding various types of Texas state tax cases, procedural process of Comptroller audits and beyond, advocating for clients during the audit, and how to preserve clients’ rights and available remedies for the administrative process that ensues once an audit is finalized. We will also briefly discuss the new ‘Wayfair’ sales tax laws in Texas and other Texas tax case updates.

1:00 - 1:50 PM - Navigating the Tax Consequences and Audit Risks Associated with the Employee Retention Tax Credit (ERTC) and Paycheck Protection Program (PPP)

Presenters: Juan F. Vasquez, Jr. and Victor Viser 

The Employee Retention Credit (ERC) and Paycheck Protection Program (PPP), popular COVID-19 relief measures, are at the center of many taxpayers’ responses to the pandemic. This seminar discusses what tax practitioners need to know in 2022 and 2023 about the ERC and PPP. Substantive focus includes the PPP forgiveness and appeals processes, ERC eligibility requirements and related issues such as affiliation rules, the alternative quarter election, and potential liability. This presentation also addresses the recognition, treatment, timing issues unique to each measure, and audit and appeals issues.

2:00 – 2:50 PM - Bankruptcy, Fraud, and Tax – Is there a silver lining?

Presenters: Katherine Noll and Jaime Vasquez

The speakers will discuss the impacts that the Tax Cuts and Jobs Act (TCJA) and COVID have had on the availability of
a theft loss under IRC 165. The interplay has become more relevant with the revelation of recent investor and client fraud cases. For individuals claiming a loss not associated with a trade or business or a transaction entered into for profit, the limitations can be significant. The speakers will discuss alternatives and outline the facts and circumstances where there may be some silver lining (for tax purposes at least), as well as the taxation of settlements and judgments and the related impact of the TCJA on deductions for attorney fees.

3:00 – 3:50 PM Review of Current Estate Planning Techniques and Review of Recent Trust and Estate Litigation Cases 

Presenters: Matt Flores and James McNeel

Review current estate planning techniques in the current estate/gift tax environment of large gift, estate and GST tax exemptions, low AFR rates, support for valuation discounts in the courts and other taxpayer favorable conditions.

A timely review of the past year’s most significant court decisions on federal and state tax issues, and a discussion of other hot topics in Tax Controversy.
