The Fundamentals of Investing In Qualified Opportunity Zones
On November 30, 2018, shareholder Philip Karter will co-present a breakfast seminar on the fundamentals of investing in qualified opportunity zones. U.S. investors currently hold an estimated $2.3 trillion in unrealized capital gains in the equities markets alone. Unrealized capital gains from appreciation in unregistered assets (including real estate) add even more to this pool of investable capital. With the passage of new Code Section 1400Z as part of the Tax Cuts and Jobs Act, Congress has created strong new tax incentives for investors holding unrealized gains to encourage investments that will be used to start businesses and develop properties in economically disadvantaged communities.
On the heels of new guidance recently issued by the Internal Revenue Service, this breakfast program is designed to provide tax, business and real estate attorneys with a fundamental understanding of the new law involving tax-advantaged investments in Qualified Opportunity Zones ("QOZs"). Panelists will address the following topics:
- Explaining the tax benefits of gain deferral and gain exclusion from QOZ investments
- Gains eligible for investment
- The basics of Qualified Opportunity Funds ("QOFs")
- QOZ investing with bifurcated funds
- Investing through partnerships and other pass-through entities
- Penalties for failure to meet QOZ qualification requirements
- Practical examples of QOZ investing
