
Patricia Flanagan, a partner in Shutts & Bowen LLP’s West Palm Beach office, recently moderated “Digital Issues, Misrepresentation & IP in the Yacht Industry,” at the Superyacht Law Summit, spotlighting the legal risks for the use of digital media and generative AI in marketing yachts and charters.
The panel session addressed online vessel misrepresentations, illegal charter marketing, copyright, right of publicity, and trademark concerns, while emphasizing the complexity and peripheral risks from the overlay of foreign, federal, and state laws. Patricia moderated the panelists through several topics, with key takeaways from the program including proactive compliance and monitoring of listing for intellectual property rights, as well as accuracy and substantiation of representations made in text and images through digital channels. The panelists also discussed the application of practical solutions, including content governance, incident response, and team training.
